Terms of Service

These terms govern your use of Perilunes (the “Service”). By creating an account you agree to them. If you do not agree, do not use the Service.

1. What the Service does

Perilunes researches prospects you identify, drafts outreach email, sends it from a mailbox you connect, and classifies replies. Drafts are generated by third-party AI models. You choose which prospects to contact and, unless you enable autopilot, you approve every message before it sends.

2. You are the sender

Messages go out from a mailbox and domain you control, under your name. As far as recipients and the law are concerned, you are the sender, not us. You are responsible for the content of every message that leaves your account, including drafts the AI wrote and you approved, and every message sent while autopilot is on.

3. Your obligations for outbound email

Cold outreach is regulated, and the rules differ by the recipient’s location, not yours. You agree that you will:

• only contact people where you have a lawful basis to do so, and comply with every law that applies to your sending — including CAN-SPAM (US), GDPR and ePrivacy (EU/UK), CASL (Canada), and any local equivalent;
• send only from a mailbox and domain you are authorised to use, and never disguise or falsify the sender, the routing, or the subject line;
• honour opt-outs promptly. The Service adds a one-click unsubscribe link and header to outbound mail and suppresses addresses that unsubscribe, bounce, or complain. You must not remove, bypass, or defeat that mechanism;
• keep a real, monitored reply address and a physical postal address where the law requires one;
• not use the Service for spam, deceptive, harassing, or unlawful messaging, for adult, gambling, or pharmaceutical promotion, or to contact people who have asked you to stop.

Compliance is yours, and it is not something we can verify for you. If you are unsure whether your outreach is lawful in a given market, get advice before you send.

4. Prospect data

You may upload or let the Service collect business-contact information about prospects. You represent that you have the right to provide that data and to process it for outreach. Where you are a data controller, you are responsible for your lawful basis, your notices, and for handling access and erasure requests from the people in your lists. We act as a processor for that data and will assist with such requests on request.

The Service maintains a shared cache of factual, publicly available information about companies (not individuals) to avoid re-researching the same domain. Your leads, ICPs, research briefs, drafts, and scores are never shared between accounts.

5. AI output

AI-generated research and copy can be wrong, out of date, or confidently mistaken. It is a draft, not a fact. You are responsible for reviewing what you send. We make no warranty that generated content is accurate, non-infringing, or suitable for your purpose.

6. Credentials you connect

If you connect a mailbox or an API key, those credentials are encrypted at rest and used only to operate the Service on your behalf. You may disconnect them at any time. Use an app-specific password where your provider offers one, and revoke it if you stop using the Service.

7. Usage limits and fair use

Accounts have limits on AI usage and daily send volume. We may adjust, throttle, or suspend usage to protect the Service, our providers, or the deliverability of other users. We may suspend or terminate an account that we reasonably believe is sending spam or breaking these terms, without notice where the harm is ongoing.

8. Availability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not promise uninterrupted or error-free operation, and we may change or discontinue features.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, domain or sender-reputation damage, or regulatory penalties arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

10. Indemnity

You will indemnify us against claims, losses, and costs arising from messages sent from your account, from data you supplied, or from your breach of these terms.

11. Changes

We may update these terms. Material changes will be reflected in the date above and, where significant, notified in the app. Continuing to use the Service after a change means you accept it.
